  Ex is on the mortgage

I read your reply to the lady asking if there would be a problem when she sells her house because the mortgage is in her ex-husband's name. You replied "no it shouldn't pose a problem when you sell." You are wrong.

When she sells, if there is any mortgage refund (extra money left in the tax/insurance escrow account), they will make the check payable to the ex-husband because his name is on the mortgage. I know because this happened to me. I then had to pay additional attorney fees to correct the problem. -- via e-mail

The fact remains, though, that the name on the mortgage won't cause any trouble in the actual sale of the property.
